Before he was okay to chair the FBI , Christopher Wray met privately with Senator Ron Wyden , easily the discriminating privateness hawk in Congress . The topic of their conversation , one of many Wray would hold with lawmakers during his check process , was encryption . The FBI has long held controversial views on the field of study ; namely , it want to destroy it . Or if not , it want to weaken it , make it easier to break — at least , for itself .

Most expert will tell you cryptography is the science of keeping secrets , but its pragmatic foundation lies alone in mathematics . What the FBI has long desired — a magical key to unlock all the doors — is not mathematically practicable . Not without endangering the base hit and certificate of all Americans . Historically , the FBI has n’t like too much about that .

Wray was uninformed and admitted as much , grant to Wyden . He had yet to form an opinion about encryption and ask time to contemplate the payoff . Nevertheless , he tell Wyden that he would rely on the opinions of expert — as opposed to blindly advancing the docket of his predecessors .

The following month , on August 1 , 2017 , the Senate irresistibly substantiate Wray to go the bureau . Citing specifically his unsuccessful person to “ oppose government backdoors into Americans ’ personal machine , or to acknowledge fact about encryption , ” Wyden , a stalwart defender of privacy on the muscular Senate Intelligence Committee , voted not to support the former litigant . It did n’t end there .

In his first public speech as FBI theatre director , Wraycalled on Silicon Valleyto invent a method by which the bureau ’s agentive role could easy go around cellular phone encoding . “ I just do not corrupt the claim that it ’s impossible , ” he say .

Having heard Wray parrot “ the same debunked argument , ” Wydenwrote to the FBI directorin late - January 2018 , say he wished to learn more about how he “ arrived at and justified this poorly - informed insurance policy proposal . ” Specifically , Wyden ask for a list of the cryptographers with whom Wray had “ personally discussed this topic ” since their July 2017 sit down . “ [ S]pecifically identify those experts who send word you that companies can practicably contrive government access code features into their products without weaken cybersecurity , ” he request .

Last week , the FBIfinally responded ; not Wray personally , but the acting section chief , Charles Thorley , who lead the authority ’s Office of Congressional Affairs . There would be no list , he said :

“ It is not appropriate for the FBI to identify specific individuals or entity with whom it may have consulted on this issue , as doing so might place those person or entities at large risk , or sabotage other security - focused endeavor . As you are aware , however , several self-governing non - governmental experts have of late in public offered what they believe to be technically feasible solutions to this complicated problem . ”

The FBI ’s reaction is , for lack of a well word , stupid . There are pot of cryptographers , demonstrate expert in the field , who are happy to go on the record . Many have even compose books on the matter . Others , such as Johns Hopkins associate prof Matthew Green , ofttimes andopenly state their viewson the FBI ’s agenda . None of them , as far as anyone can tell , are in any danger .

“ The boastful threat I can see is that a bunch of nerds might make sport of them on Twitter , ” Green tell Gizmodo . “ This is a very foreign response . And does n’t serve move this disputation onwards . You ca n’t turn over people who are afraid to participate in that debate , ” he added .

Some officials are well-chosen to deliberate , even if they lack the didactics required to be consider expert in the technology . But while Deputy Attorney General Rod Rosenstein is no authority on encryption , he is theorise to be an authority on the law — which makes some of his takes on the subject all the more enigmatic .

Our society , he claimed inan October 2017 speech communication , two months following Wray ’s confirmation , has “ never had a system where evidence of criminal wrongdoing was entirely impervious to detecting , especially when officers obtain a motor hotel - authorize warrant . ”

That statement , as Electronic Frontier Foundation world-wide counseling Kurt Opsahlkeenly observe , is total nonsense .

“ We ’ve always had ( and will always have ) a perfectly dependable system whereby felon can hide their communications with strong security , ” he say , stating what should be obvious : “ In - person conversations . ”

In the same speech , Rosenstein go on to assault default end - to - end encryption , take that the company deploying it are doing something “ the law does not allow telephone carriers to do : exempt themselves from complying with court order . ” Here , too , Opshal easy dispatched Rosenstein — not with some witty retort , but with a simple reading of the law that Rosenstein pretended to know by heart .

The Computer Assistance for Law Enforcement Act , he noted , does not actually require phone carriers to decrypt communications , as long as it ’s the users themselves in possession of the keys . Here ’s what it in reality says :

A telecommunication carrier shall not be responsible for decrypting , or ensure the government ’s power to decipher , any communication encrypted by a indorser or client , unless the encryption was provided by the mail carrier and the carrier possesses the information necessary to decrypt the communication .

Wray never replied , so more than a year afterwards , Wydenwrote again : “ Experts have read repeatedly , for decades , that strong encoding is incompatible with backdoors . solid encryption help oneself ensure both security and liberty , and Americans rely on this security to protect the positioning of their families and the intimate details of their communication from cyberpunk and foreign criminals . ”

“ It is foundational to American liberty that individuals sense detached to carry their profoundly hold , but controversial , impression without concern of prying center or ears , ” he continue . “ recognise you ’re being watched — or that you may be overheard — conduct to ego - censoring that would Ben Franklin roll over in his grave accent . ”

The FBI ’s decision to deduct the names of the expert Wray allegedly speak to before develop his opinion on encryption suggests only one affair : that , perhaps , he has n’t spoken to any — that there are no cryptographers advising him ; that there are no actual expert in the field of honor at all informing him .

His only consultant , one might assume ( in the absence of any grounds to the contrary ) , are career FBI employee with the long - halt belief that there ’s nothing Americans intercommunicate in private that should be beyond their major power to gather up .
